The Australian Partner visa allows spouses or de facto partners to live in Australia temporarily and eventually permanently. Types of Partner Visas
There are a couple of pathways available under the Partner visa:

Subclass 309/100 (Offshore Partner Visa) – For applicants who are outside Australia at the time of application.

Eligibility for a partner visa

A marriage or a de facto relationship may be the basis for an application. In either case, the Sponsor (spouse or partner) must be an Australian Citizen, Permanent Resident, or an eligible New Zealand Citizen.

You and your spouse/partner must be mutually exclusive.

The relationship must be genuine and continuing.

You and your spouse/partner must either live together or live apart for a temporary basis.

The sponsoring partner must not have previously sponsored more than one other fiancé(e), partner, or spouse for migration to Australia, and must not have sponsored anyone under a partner or prospective marriage visa within the past five years (unless compelling circumstances apply).

To demonstrate the genuineness of your relationship, applicants are required to provide documentation across four key categories:

Processing time

The processing time varies depending on several factors, including individual circumstances, the completeness of the application, and current caseloads at the Department of Home Affairs. The temporary partner (subclasses 820 or 309) visa may take anywhere from a few weeks to up to 24 months to be finalised.

In cases where the application exceeds 24 months since lodgement, the Department may assess both the temporary and the permanent partner (subclasses 801 or 100) visa together. If eligible, you may be granted the permanent visa without needing to apply for a separate application or provide additional documentation.

​What's next?

Once your temporary partner (subclass 820 or 309) visa is granted, you will be permitted to live, work, and study in Australia while awaiting the assessment of your permanent partner (subclass 801 or 100) visa.

You will generally hold the temporary visa for a minimum of two years from the date of your initial application before progressing to the permanent stage. During this period, it is important to maintain your relationship and retain records that demonstrate your ongoing commitment to one another.

We will support you in preparing for the next stage of your application, ensuring a smooth and efficient transition to permanent residency and, subsequently, your citizenship application.
If you are engaged to an Australian citizen, permanent resident and plan to get married, the Prospective Marriage visa (subclass 300) could be the ideal pathway for you. This visa is designed for people who are outside Australia and intend to marry their Australian partner. It provides the opportunity to enter Australia, get married, and then apply for a partner visa after the marriage.

Once granted, the visa is valid for nine months, during which you are expected to marry your sponsor.

To be eligible, you must demonstrate a genuine intention to marry your partner and live together as spouses. The marriage can take place either in Australia or overseas, but it must occur within the nine month validity period of the visa. You must be outside Australia both when the application is lodged and when the visa is granted.

During your stay on a Prospective Marriage visa, you are allowed to live, work, and study in Australia. After your marriage, you can apply for the partner visa to continue living in Australia on a pathway to permanent residency. This visa is suitable for couples who are not yet married but are in a committed, genuine relationship and planning to formalise their marriage in the near future.
Are you a family member of a New Zealand citizen who is already living in Australia or planning to live in Australia? If you’re not a New Zealand citizen yourself, this visa could help you stay close to your loved ones.

Who is this visa for?

The Subclass 461 visa is designed for partners, dependent children, and certain other family members of New Zealand citizens who hold or are eligible for the Special Category (Subclass 444) visa. It is specifically for those who are not New Zealand or Australian citizens themselves and want to join their New Zealand citizen family in Australia.
